Mr Habib, an Australian citizen, was arrested as he left Afghanistan and was then takento Egypt, but was transferred to American military custody back in Afghanistan on April16.

Mr Howard said there was no suggestion of any direct links between Mr Habib and Mr Hicks.

He said it was too early to say anything definite about the situation with Mr Habib.

"We can't say at this stage whether he would be liable for prosecution for the breachof any Australian law," he said.
